Can I get married in the US with an US citizen, live the US and apply for the green card in my home country?

Woodrow Neyman: No, you cannot get a green card unless you are living in the US. If you get married in your country you cannot get a fiance visa as you are already married. You could get married in your country then your spouse would apply for a K3 spouse visa on your behalf. You would need to stay in your own country until the K3 was issued

Ha Wolski: When you file to Adjust Status! you now have to file for EAD and for Advanced Parole. With the advanced parole you will be free to travel back to your own country and to return to America. Advance parole can be granted very quickly if you have medical evidence that you really must travel quickly.

David Boehler: The proper way to file for a green card through marriage, unless you're in the US on a visa (workers, student), is from your home country. If you are in the US illegally with no status, it will be difficult but still possible. If you go ! back to your country and try to come back into the US, they wi! ll question you and if you say you're coming to the US to get married... I guarantee you will be denied entry. It's easier to come to the US as a fiance compared to a spouse. Don't get married! Have your husband file a K1 Fiance Visa. If this is approved, you will be granted one entry into the US and you must get married within 90 days of this approval. Once you are married you will file a I-485 - Application to register permanent resident. In order to get approved for that, there will be an interview with an immigration officer to make sure your relationship is legitimate. If approved, you will receive a conditional residence. You will have the green card but it's conditional to make sure the marriage works out. It will expire 2 years from the date of which you were approved. Before it expires you must file an I-751, application to have the conditional status removed. You must renew them every 10 years. Galen Gowers: If you are here in the US legally then get married. Your husband can apply to adjust your status, along with other forms, but you can also apply for what is called advanced parole. Once it is granted you can then go home and then return to the states as needed.When my husband came over and we got married, we had an immigration attorney helping us. At the time of our marriage my husbands dad was VERY sick back in England, and we were not sure he would end up living (he had advanced prostate cancer) Our attorney suggested we file for advance parole for my husband since his dad was so sick. Our attorney told us that the advanced parole would give him the right to come and go between the 2 countries, even though his paper work to adjust his status was still being processed. All we would need to do is provide some prof that my husbands dad was gravely ill, such as a l! etter from the doctors. And that's what we did. He got his advanced p! arole within a month of us applying for his adjustment of status.So you could do the same thing.
